Recieved a standard reply letter stating, thank you for your inquiry and you can track your inquiry through our tracking system. It is dated Nov 06 2008 A.M 01 and is attached to the letter we sent along with the envelope. I don't know if anybody else has recieved the same reply. We will have to see what we receive from other centers if we receive one. Thanks

You have chance of winning lawsuit if they reject you just based on immigration status. But in USA the employment is at will basis. Both employer and employee can take that option. Last year when I got offer letter that was specified in first page that this employment is at will basis. Lawsuits are more expensive. Generally lawyers will share the benefits of compensation if they take the case freely

Hi,
I am currently working in Skilled visa through one of MNC company.I am working for this company for last 4 years and prior to this company i worked in another small company for two years.When I join my current company i provided all the legal document like exp,last two month pay stub and releiving letter and they did BG . They did not find anything wrong with prior employer in last 4 year. recently they found something wrong about my prior employer and asking me providing additional document and unfortunately company is closed or rename. I have told my current employer that i don't have any more evidance of my prior employer.Because of this reason they are asking me to come back india.
Is there any way that i can take legal action against this company in US because from last one week
they are harrassing my like anything.

They are just giving you BS. They are trying to use a fake reason to send you back to India. They might be using this fake reason (BG check) to avoid any legal hassles. Keep track of how they are harassing you, keep a copy of all emails and documents used in correspondence in this matter and complain to DOL.

• Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.

• Allow visa revalidation in the United States.
• Reinstate premium processing of Immigrant Petitions.

If clerk is doing this as per instruction means, we are being noticed and that is precisely what we wanted anyways. I don�t think USCIS higher ups have any malicious intent. Whole issue may be due to lack of training of IOs.
I think we are getting noticed. With Ombudsman's office also, we initially got a very generic response - but now we are getting more specific response and asking us to provide more info. With USCIS officials it might take a bit longer but we need to keep sending letters and they will realize the issue.
They may not have any malicious intent but if this practise is not brought to their immediate attention it can become more prevalent. Rules surrounding AC21 are confusing and they never got into rule making process. By raising this current issue - we might even get lucky in convincing USCIS to speed up the rule making process of AC21.

Nice! So what you're saying is that this creative form of protest is a waste of time, even though Mr. Gonzalez responded to it? And we shouldn't indulge in creatively letting our heart-felt feelings known to a step that can be termed as nothing but injustice, and unfair to all uncocerned.
- Injustice to the hard-working USCIS folks who had to work the weekend before the 4th of July week... (frankly, not the fault of USCIS rank and file, they have our collective sympathies and certainly mine)
- Injustice perhaps to Dept of State and Ms. Condi Rice who had to answer the ridiculous questions when DoS was going about its work as normal, or so it seems

Or we can let the world know about this injustice, and hope for a fair hearing on the issue (rather than having it ignored completely), by at least getting a shot at getting the ability to file pursuant to the original July visa bulletin.
Perhaps you were'nt on the same roller coaster ride we were put through these past few weeks since June 13th, or perhaps you don't care enough.
Either way, it doesn't make sense to dissuade the majority from pursuing their creative forms of protest - at least for Mr. M. K. Gandhi's sake and ideals.... :)

This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??

Anyway, our turn will come sooner or later, so why to become impatient just seeing the JULY bulletin CURRENT and then "U".

Yes, the old system will be restored. Please note that this is the only sure fire way of EB3-I going forward. There is some comments that EB3-I can really only benefit if EB2-I goes current with the current horizontal spill over rules. Such statements are clearly misleading. Eb3-I will not directly be impacted by EB2-I being current. It just allows EB3 to get a lot of numbers which will first be used by EB3-ROW before spilling over into EB3-I.
With this change, we get EB3ROW move ahead faster, it probably would have been C had the rules been followed, and EB3 would have started moving ahead.
The only way for EB3 to move ahead is for EB3-ROW to become current, nothing else will help EB3 beyond the visa recapture (which is iffy at best). If we get USCIS to follow rules, this happens sooner, and EB3-I starts to move sooner. If not, EB3-I shall wait for a long time.

My reasoning for less than 3k visas for EB3 I
Assume EB3 I has 2800 available per year
2800/12 = 233.33 per month.
The spread sheet shows that there are 135 pending with PD of March 01 or less. Which is less than 233 the PD did not cross April because there are 452 applications in april. A PD of April makes sense. Using calculation the PD will be July 2001 in Dec.
if you assume 8080 visas per year then there will be 673 visas availble per month and the PD should have crossed to May 2001 because the total pending 485s on May 1st are 587. If we go with your assumption then the PD in December will be at Jan 2002...I

I am in also facing the same situation...My employer says, the attorney clubbed some applications into one box and sent it, and donot know which box my application is, hence no fed ex number. Hopefully it should he been reached by july 2nd...No Receipts No Checks cleared...waiting for Sept 30 to call USCIS (after 90 days of filing)...most probably my application would have received by R.MICKELS, Delivery date: Jul 2, 2007 9:01 AM. I have got a list of tracking numbers from the attorney, only this tracking number details shows 4 lbs...hence thinking that my application is clubbed in this one. This was sent to Nebraska service center, My I-140 approved from Texas on June 25th. CAdude, Can you add my details onto the list. The compiled list show the time stamps are very close....
