All right, looks like we got (or will get) some attention from media. DOS and USCIS got (or will) it too. That's good. They will forward flowers to hospital, and this is good too (hate to waste flowers)! It is rather unfortunate that people on consular process track despite the fact that they have approved I-140, yet they couldn't be allocated visa while other people on adjustment process could file their I-485 when everybody PD became current. don't you think it is rather unfortunate.
Any hope for consular processing? with the situation.

I cannot renew my Driver's License if I don't have a valid work permit. I doubt whether the Receipt notice is enough for the Drivers License office to issue a new DL. I changed my employer and the new employer may ask for a new one. But I'm hoping that I might get one in less than 3 months. Let's see

"Many people are in your scenario.
There are many ways to do this. Each one being a little more expensive then others.
What can be done:
Your wife files as primary and you secondary on her 140.
You file as primary and her secondary on your 140.
Option #2
You file alone on your 140
She files alone on her 140.
Somehow if the dates should move backwards and her 140 on labor substitution should get denied (you never know with labor sub); then for her to file on your 140 the date has to be current or she canʼt file until it becomes current.
You and her just file on her 140. Problem is if the 140 gets denied then the window of opportunity to file the 485 again may not be for a couple of years.

If you want to be safe and want to spend more money then she would file as primary on her 140 and you as dependent. Then at same time we would file you as primary on your 140 and her as dependent on your 140.

You have 2 choices. You could pick a case that you are going to proceed under, most likely the one with the earliest priority date, so long as there is confidence that the I-140 will be approved. Or, you can hedge your bets by each filing as your own primary because if one of the cases falls into a problem, the person can switch to be a derivative, but could run into a problem if there were not current priority dates at the time. But, so long as your both remain in H-1B status, and not use EAD/AP, that is minimized"

and EB2 I/C pre-07/2007 still have about 34K at the beginning of oct/2010

No, you can still get your EAD while your I-140 is pending as long as your PD is current and you can file for 485. But I would not change jobs with AC21 till the I-140 is approved, if I were you.

A basic question - Are the months that the numbers are slotted into for the Priority Dates? or are they the recept date or something else....?

That's not correct. FBI cannot deny somebody a visa JUST BECAUSE they cannot do their job in a TIMELY FASHION. Law states that "YOU ARE GUILTY ONLY WHEN ITS PROVEN"
Also, Please keep in mind there are over 12 MILLION ILLEGALS WITH NO RECORD!

I have also sent group emails to my batchmates from my engg college asking them to join IV. I think everyone should do that - this will help IV to Increase its Memberships.
I had one more suggestion too - (this has recd less support in the past).
we need to put in a statement that many legals are not buying a house because of the uncertainity in the GC process. even the congressmen will be more patient with our cause when we mention housing.

Now it almost reached a point that attorney fees for 485 will be too much to chew. My question is how to handle this situation, like convincing the attorney and he handing over all the papers etc..

Hi everyone,
I have 2004 W2 but cant seem to find my tax return. I have 2003, 2005, 2006tax returns but not 2004. What can I do to get that return. Please any advice will be nice.

Before you file the law suit consider this,
The system is designed to get GC faster to the smarter (EB1, EB2, EB3 etc) or the rich (Investor). Sometimes circumstances decide in which queue you start the journey, Employer, attorney, how many days left in h1b etc, etc, etc
I do not like to jump queues and resent people who jump queues. But these are the people who look for opportunities and exploit them. These are the smart ones.
System favors people who are skilled (higher the better), By finding (new Labor, new I140) and using an opportunity these people have proved that they are worthy of the faster queue (eb3 to eb2, eb2 to eb1 etc).
What is wrong in rewarding the hardworking smart person with the original PD. After all that PD was established for that person(thank god LC sub is gone). That is the day an employer decided to sponsor GC for that person.

Your reward is you get to start the journey in EB2, 1 year+ in EAD and 6 years in H1. If you are really smart you would have got your employer to apply for GC with at least 5 years left on your H1 clock.
