How can the current position (EB3) relevant when the new employer is filing your GC for a future job (Eb2) ?
Does the employee need to get promoted in the current job to apply for a future EB2 job ?
Good Question. AC21 usage introduces a "Chicken Or Egg" situation. Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.

I also received response to SR for me and my spouse that our cases are under review and allow them 60 days. Did you send an e-mail to TSC after you received the response to SR or before. Also what did you write to them in the e-mail. If you can share that would be great. I am still waiting after becoming current in Sept.
I received a similar response to the 2nd SR. I was told that my case was under additional review and to allow them 60 days. However, my wife's case had been assigned to an officer for review.

I have a question regarding this whole idea of filing on your own:
Whats the reason for doing this? Is it because:
1. Attorneys will be busy during this time
2. Employer will not file 485
3. Bad Experience with Attorneys
4. Anything else please explain
If 2, whats the guarantee that he will not cancel your LC/140 once he knows that you are filing on your own?
Sorry about bringing this up. My employer is ready to file 485 but not EAD and AP. He says if we don't renew our EADs on time then we will be out of status and hez seen lot of such cases. Can I file EAD and AP on my own and let my employer file 485?

I almost lost my driver's licence renewal in April due to their procrastination and slowness in apply for H1 extension. If they do the same thing in this, then dates can retrogress and window of opportunity closes.
Besides, I somehow feel that errors on forms are more likely when paralegals do your paperwork rather than you doing your paperwork.
I am planning to keep a backup of all paperwork to file on my own if the lawfirm fails to file it by the 7th or 8th July. I will fire them and tell them to back off and do this on my own. I think that if they cant burn the midnight oil and work overtime during such critical times, then they deserve to lose business and we deserve to take care of our problems.

My attorney is planning to send out the paperwork on June 29 to reach by monday july 2nd , is there any problem to this, is there any risk involved in sending on 29th, is anybody else doing this ? Please respond, this is urgent.
I read somewhere in the forum that one guy contacted USCIS regarding I-140 PP and he was told by USCIS representative that they honor Postmark date. If USCIS honors Postmark date not the receive date they one must be careful sending application on June 29th.

How long are we going to hang in there? :mad: Thanks everybody for support and advice, but, there is a problem here. I am mad at USCIS, not the supportive people here. I am a concurrent filer, I don't even know if my package was lost, if it was transfered or not. Or, if it was tranfered if it was a successful transfer. Every other implication aside, it is worth a lot of money. :eek:
May be I am too negative, but, my J-1 waiver package was lost back when it was done by paper. Literally lost (!), although I could locate the person who signed it in. My SS#, all background information, a check showing my checking account were in it. I told them, my privacy information is in it after I applied for the waiver again. I asked them if they could look for the envelope and destroy it. They "nicely" told me I have no rights at all to make such a request. I asked them if they have a system of destroying people's private information if it is no longer use, they said no.
These should be our simple rights as a people who pay taxes in this country, although we are not residents yet. We can go to court for an everyday dispute, but at USCIS no rights.
Anyway, thanks for involuntarily sharing.

Actually I want to know how we can check that our I-485 is associated with EB2 and not EB3. Is there a code for this on I-485 application?

we should do something ASAP before they decide upon Oct'2008 VB. Before FY2009 starts, we should make sure they are aware of EB3 problems so they can come up with new rules for new year.

I dont think it's true, I saw these rates are under international calling plan, so we are not signing up to that plan, so I would strongly believe that all cell phone calls are included to India, the same thing you can see when we click on the 60 countires list.....so find out with the tech support guys and keep update here to get the accurate answer on this...
I just spoke to customer service .they mentioned all cell calls to india are free under this WORLD plan.who ever is signing up , can proceed , can call customer service to confirm this as well to avoid any surprise charges

if a change in interpretation is done intentionally, then USCIS admits they were allotting visas incorrectly during the previous years...if it were a public company, lawyers would be climbing over one another to file a class action suit...unfortunately all we can do is write letters, make phone calls and pray :rolleyes:

I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. Please check on following link.

I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:

2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

I think it would be fair to split the leftover numbers the same way they split whole year quota.
50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?

I received a phone call (WOW!) from a sweet lady from CIS Ombudsman's office. I sent letters to his office and in the letter I mentioned my cell #. Anyway she wants a real person who got deniel. I told her that my friend got deniel (IVens are my fried). Anyway, she sent an email too after I asked her to give her info so that my friend can send her his case details. Unfortunately, the email I received shortly after the conversation, looks like general and does not have her ID. Please PM me if you like to hear more about the phone call.

It would have been great if their follow-up email had some more details but in any case please share any info (like phone number your received call from) with pd_recapturing - he is culling info together from the people who are really affected.
