    1) Talk to your employer and see if he is willing to support your I-140 while you are away on leave of absence, if he agrees then great!

    2) Talk to your school and check if they will differ your admission by an year.

    3) Go anyway...forget about US, you can do great in Europe or Asia too

    Canada is a great country, I am sure there are plenty of good trash cans all around the country, surely they can hold a small litte I94.

    Or how about getting your I 94 framed and selling it on ebay?

    Dude, You can use I-94 card as a toilet paper when you take the very first exit in Canada. You are leaving for good! Do not worry about it. Meanwhile, congratulations for taking this bold step and moving to Canada after 6 years of H1-B. I wish you well.

    It's ridiculous how people start to bad mouth everything related to US once they get a PR from another country, especially Canada. It�s like kicking off the same ladder that you used for climbing.

    1. You gained entry into US with the �toilet paper�.

    2. The �toilet paper� allowed you stay legally in this country.

    3. The legal stay enabled you to apply for Canadian PR from Canadian Consulate General in Buffalo where the processing time is less than 2 years.

    4. The legal stay enabled you to earn sufficient funds which you showed as proof of funds in your application papers.

    5. The legal stay enabled you to get police clearance certificates from FBI and also from your country�s consulate in US.

    Now let�s say you didn�t have this �toilet paper� and applied for Canadian PR for India.

    1) You would only be eligible to apply from Canadian Consulate General in NewDelhi where the processing time is more than 5 years.

    2) If you are from a middle class background, then you would have a hard time in providing the proof of funds for a family of 4, with your earnings from India.

    3) You would have to grease the palms of police to get police clearance certificates and they are gonna take their own sweet time to provide you these documents.

    Now be thankful that you got away from all these with the �toilet paper�. And remember that you are leaving to Canada not because of your love for the country, but because you didn�t get your US GC on time. Sour grapes, huh?

    I know that i will be getting red dots for this post from hypocrites and I don't give a damn about it. All I can say to them is "Instead of pressing your finger against the mouse, press it against your forehead and think about the benifits that you milked from this country".

    Yes, some states do not give driver's licenses if your H1B is less than 1 year. P.A. is one of those states. This point was our main talking point to get the 3 year Vs. 1 year H1B extensions.
    During the Fox news channel interview of Aman Kapoor, I heard the issue of Drivers licence renewal mentioned. I have heard that people who have one year or less than one year on their work permit have difficulty getting renewals.

    Is that true and if yes, is it in every state?
    Has IV mentioned this issue with the senetors etc as part of the backlog and retrogression issue?

    Pls. post more details if you know. It would help us to be more aware and educated about this issue so that we can address this with more details when we contact other people and our employers.

    Anti-immigration groups up against unusual coalition
    By Patrick O’Connor

    The National Restaurant Association usually does not join forces with the National Council of La Raza, and the U.S. Chamber of Commerce rarely, if ever, aligns itself with the Conference of Catholic Bishops.

    But those organizations and many others have come together in support of a comprehensive immigration-reform bill that would expand guest-worker programs and offer undocumented workers already in this country a path to citizenship. They are up against an aggressive cross-section of single-issue organizations that favor increased enforcement of immigration laws and have condemned any legislation that would allow undocumented workers already here eventually to become citizens.

    With the Senate Judiciary Committee expected to mark up its version of the immigration bill Thursday, groups on either side of the issue have geared up for a hard fight, and the vehemence and intractability of either side should make compromise particularly difficult for lawmakers on Capitol Hill.

    Staff members of many of the organizations involved in this fight stayed up much of last Thursday night poring over details of draft legislation released by Judiciary Committee Chairman Arlen Specter (R-Pa.) in anticipation of this week’s markup. By Friday afternoon, many of those organizations released statements either heralding or deriding Specter’s draft.

    Senate Majority Leader Bill Frist (R-Tenn.) has said he would like to move a bill to the floor by the end of March, meaning next month is critical in the years-long debate over immigration reform.

    A unique coalition of divergent interest groups have rallied in support of a bill introduced by Sens. John McCain (R-Ariz.) and Edward Kennedy (D-Mass.), with select members of the AFL-CIO teaming up with social-welfare organizations, the Chamber and other business groups that support a temporary-worker program.

    “The fact that the Chamber of Commerce needs comprehensive immigration reform is very good,” said Flavia Jimenez, an outreach director for the National Council of La Raza, a Hispanic advocacy organization.

    Members of the business community also appreciate working with groups such as La Raza because it allows the overarching coalition to communicate with Republicans and Democrats alike on Capitol Hill.

    “It’s nice actually to get to work with these guys,” said John Gay, a senior vice president for government affairs with the National Restaurant Association, which co-chairs the Essential Worker Immigration Coalition (EWIC), a group of more than 40 business and trade associations seeking comprehensive reform.

    Because the many groups within this broad coalition have slightly different priorities, they must communicate regularly to push common themes. In the end, these organizations are all fighting for what they consider the best interests of their dues-paying members.

    “When push comes to shove, we will all become … forceful advocates for our members,” Gay said. “If we’re at an impasse on something, it’s not through misunderstanding. When we differ, it will be for real reasons.”

    Despite the breadth of interest groups advocating an expanded guest-worker program, the enforcement-only crowd makes considerably more noise on Capitol Hill, if the flood of mail, e-mail and phone calls to member offices is any indication.

    A handful of single-issue groups opposing the guest-worker program have effectively put the other side on the defensive since President Bush first announced his intentions to push comprehensive immigration reform, as evidenced by the administration’s backtracking since Bush first proposed such a program in January 2004.

    One of those groups, Numbers USA, has 135,000 registered activists throughout the country and an e-mail list in excess of 1 million subscribers, all of whom have signed up voluntarily, said Caroline Espinosa, a spokeswoman for the group. A link on the Numbers USA website also allows browsers to fax a personal note to members of Congress in support of increased enforcement of illegal immigration.

    Numbers USA also does objective and subjective summaries of each bill introduced on the issue and notifies subscribers in advance of any important actions on Capitol Hill, such as this week’s markup. As such, the group was expected to send an alert asking those supporters living in states represented by members of the Senate Judiciary Committee to call or fax their members in anticipation of that markup.

    Unlike their counterparts on the guest-worker side of the debate, these single-issue groups do not coordinate to the extent of their rivals.

    “We’re pretty separate,” Espinosa said. “We don’t even share resources, even though we’re all working toward the same goals.”

    Battling with groups like Numbers USA is an uncommon experience for many members of the business community because they do not regularly work on such socially sensitive topics.

    “We don’t usually end up on the other side of single-issue groups,” Gay said. “That’s unusual for us.”

    McCain was scheduled to appear at a union hall in New York City yesterday with a number of these groups as a demonstration of how the expanded guest-worker program is attracting broad, bipartisan support.

    The White House has sent signals to Republicans in both chambers that it favors comprehensive reform, which could include an expanded temporary-worker program. House leaders passed an enforcement-only bill under the assumption that the Senate would take up the more politically difficult guest-worker issue.

    The anti-immigration crowd has political momentum at this stage in the fight, with congressional Republicans wary to cast any vote that could turn off their conservative base during this critical election year, but members will also have a hard time ignoring such a broad cross-section of business, labor and social groups with their own self-interested constituents.

    “We’re not trying to damage America,” Gay said. “We’re just trying to keep our restaurants open.”

    Hi

    Only My wife has got a medical RFE.
    It talks about going to original civil surgeon and getting a TB test again and a Xray.
    Did you face a similar situation as ours?
    If yes can you throw some light on how to proceed.
    I cannot go to the same surgeon since I live very far now.
    Also worried why they have generated this RFE when I had submitted everything properly!
    Anyways any guidance provided is much appreciated.

    Our strategic Counsel, Quinn Gillespie & Associates (QGA) has begun setting up meetings for us with lawmakers and congressional staff in a big way.

    Three of our volunteers are in Washington DC this week. Yesterday, we met with Chief Counsel of the House Sub Committee on Immigration and also California Congresswoman Zoe Logfren's Senior Aide and get the House view on Comprehensive Immigration Bill. We were also interviewed by Kate Ackley, Reporter for Roll Call (http://www.rollcall.com/). Roll Call is THE newspaper read by lawmakers and their staff and the best way for us to get the message to them.

    Today they have already been to White House and spoken to senior people to get the Administration's view on immigration. They have 2 more meeting for the day.

    They have another full day on Friday and Monday also, when they will be meeting with 3-4 Senator's staff on each day. All these senator's are high powered senators who will be able to very much further our cause.

    More details of these meeting will follow shortly, when they are able to get a breather from all those meetings.

    To maintain this kind of excellent service provided by QGA, we urge our members to please contribute monetarily to IV.

    Thanks for sharing your experiences. Is LLC corp employer eligible to do H-1 transfer? I have an American citizen friend who has a LLC corp and work as an independent contractor. Can he file for my H-1 transfer and can I work for him?
    His annual income is about 150 to 200K. I think he takes about 100K as salary and rest as company profit.

    I have my 140 approved and 485 pending (>180 days).

    Any potential risks with this approach?

    The Process of giving Birthright citizenship is a law called Jus Soli(14th Amendment) which was implemented in 1900's . Numbersusa and others are fighting to change the Jus soli to jus sanguinis which gives citizenship based on the child's parents Status to reduce the "Numbers".India Abolished Jus Soli in 1987 and dosent offer Birthright citizenship. I think going this Route to discuss the possibility to fight for parents naturalisation based on child's status will make us no different from Illegal Immigrants.

    belive it or not, I knew that. I mean the part about the US, not the part about India as I don't hail from there.

    The point that I was trying to make but did not state clearly enough was that I feel that when one has a political agenda whether it is pro or anti immigration, children should be kept out of it. Labeling children like anchor babies is dehumanizing. I believe that when kids are involved, as human beings, everyone should always be concerned about their best interest rather than what our political view.

    This is why I hate the term anchor babies. The antis are willing to even dehumanize kids if it fits with their political view.

    As per USCIS official report as of end-August, there were more than 500,000 pending AOS applications:

    So, if we estimate that there were about 100,000 more AOS applications receipted during September and October, that is a total of 600,000.

    I know this topic has been discussed in other threads as well and those threads got buried over the Period of time but this is getting beyond limit now - let me know if anyone has any good idea or if we can do anything together......

    My PD is EB3 Mar 2005 and my 140 is applied in EB3 May 2007. at NSC (Nebraska) Its been 13 months and no signs of movement and no one is helping . Here what I did on a personal level and here is what i heard.

    a) Contacted USCIS - they said contact employer/lawyer because they are the beneficiary.

    b) Contacted Lawyer - they said 'Pls wait for some more time' & then ask employer.

    c) Contacted Employer - they said that we can't push lawyers unless your case is passed 2 months from Processing Date update.

    d) Contacted Local Congressman - Told them that the Processing Date update is a farce and USCIS (NSC) moves them back n forth just to save their Face. This is really unfair for a certain category of peoples. They took my case no. and inquired and then said that since you have a parallel H1B and a job - we would wait. If your existence in US comes on the Line then we will Jump in and help you. We are sorry but we can't really expedite unless a emergency comes.

    Now tell me folks what other options we all have - NSC is just messing with EB3 140. Whatever is the workload this can not happen. Do we still have some options to work on (apart from sitting idle and pray) ?

    I am just trying to find out the average Lawyer Fee and Cost of GC (including Labor, I-140, 485, AP, EAD etc)

    So far I have paid 8K to Lawyer and USCIS.

    PERM: $1400 (case approved)
    I-140: $1200 (case approved)

    I-485: $1200 for primary applicant, $750 spouse, $500 per child

    My company paid for H-1B and GC

    suggest you call CIS if you have only have to reschedule your FP. I'm a NSC > CSC >NSC filer, I was out of the country when my FP arrived. So called and rescheduled after returning and received new FP's a week later.

    I never said school can force her to maintain F1. All I said was if she wants to be on F1 (for whatever reasons) she needs to comply with school's policies. Also her maintaining or not maintaining F1 is immaterial to her legal immigration status in the country (which is safe by the virtue of pending I-485) it is just that she will cease to be on F1 status (her current non-immigrant status, just obtaining EAD doesn't mean she has abandoned F1 status, she needs to use it)
    Also, she will no longer be on any non-immigrant status when school cancels her F1, from that point on her status will solely be based on I-485 and its outcome.

    The school policies does not determine whether someone can be on F1 status or not. Government has laid down the rules for F1 status. School cant say that one has to take so many credit hrs for that person to be on F1. The rule is that to maintain F1 status, one has to be a full time student with minimum 3 courses , thats 9 credit hrs, but the exception is the final semester where that student can have less then 9 credit hrs.

    Plus since the F1 is not a dual intent visa type , when someone applies for 485 , the F1 status is forfitted. what you are mentioning about the previous non-immigrant visa status continues even after obtaining EAD and remain so until EAD is used only applies to the non-immigrant status like H1 , H4 , L1 etc which are dual intent visa types. For F1 your statement does not apply.

    im on I-485 pending. but had to stay in H1B ( 8th year ) to make my wife stay on H4. i have plans for india this spring and do you see any issues while i go for H1B stamping in chennai ?. Any recent experiance / advise would help. thanks.

    Dont forget the APs. Sometimes they refuse h4 stamping if I485 is pending. In such cases use AP.

    As far as I know, starting a PERM application in itself does not amount to an intent to immigrate - it is simply a labor market test for a future position.Remember, the employer can port the LC to a different employee at a later date. I-140, however is an application to immigrate permanently to the US; hence a violation of the F1 visa. You may have a difficult time getting your I-485 approved or have to go in for consular processing. It is best you consult a lawyer on this one; don't count on random opinions on the forum for such a serious issue.
