Guys: This has become a major problem at every place. If we do not take any action, every one of us will be replaced by these BIG outsource companies with L1 and B1.
I already reported this to ICE about violations of CTS which has placed their L1's at client's place for the past 2 years. And still they have several people.
You may not believe their pay. I do not want to put a number here and it will be a shame on CTS for misusing L1. They replaced 18 American Workers at my client's pace. Whatever you guys might think, this is a FRAUD.

Seems logical, but on the other hand if that were to be the case, then why isn't there a spike in June-July '07 to reflect the deluge of 485 filings?

Milind123, I can certainly understand your frustration but kudos to you for making your post humorous at several points amidst your painful experience. I especially liked your closing remark about Koh-i-Noor - I'm with you. :D
Come to think of it, even the country where we are right now (i.e., the US) isn't much different not only in terms of lengthy forms and queues (outside of consulates) but also on making our lives a little more than hard by denying driver's licenses, delaying permanent residence perpetually etc. On top of these issues, apparent hate crimes against Indians at LSU and then at Duke would certainly make a lot of parents a little nervous before sending their kids for higher education here.

I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don�t have a valid US visa. (Note: If you have AP, and don�t have a valid visa, you still need a TV).
I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don�t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).
Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the �I will kill you right now� look on my wife�s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).
It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.
I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don�t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the �good feeling� that you experience during the days leading to your trip.
I haven�t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

I think its only when things get reaaally bad that it forces people to stop and take notice. An example is the July 07 fiasco. That was wrong on so many levels. I thought just like a lot of others " They cannot possibly get away with this. Can they?" People made enough noise and DOS/CIS had to take corrective action.
With the new interpretation also looks like someone made a decision without fully understanding the consequences for EB-3 I folks. I think this is an outrage for EB-3. To be stuck in 2001 and no relief in sight. I think we should make our voice heard.
I understand Eb2 guys trying to protect their advantageous position with the new interpretation, but we need to fight for our position:mad::mad:

I have sent an email to 1800flowers.com to offer special price or sponsor this campaign as they may also get benefited from business or media coverage. I would suggest that we should speak to other flower shops and see if they will sponsor and it may increase the numbers and people who are shying away from high cost of flowers can also start participating. Also, we should come up with a new date or extend the time to send the flowers to increase the numbers.

For the nth time.. numbers are reduced only after approval and not based on receipt of application. So if you can submit it on July 2nd you submit it on 3rd and so on.
485 Approvals are coming in thousands every day ( as per the increasing activity on pending 485s)...and DOS can any day suspend if they think numbers are over ..so if you are lucky on 2nd you are in and so on ..remember GCs are not only approved in US only it been happening at all the visa posts all the world

Ganguteli, why do you keep on questioning everybody's intentions all the time. the other day, I had posted about L1 exploiting the loop to file GC in EB1 and your answer was plainly stupid and irritating - "I would have done the same thing if I had a chance"....
There is nothing wrong in exposing any kind of visa fraud...I came here on F1 10 years back and still in line for GC after getting masters from a decent school and working with major employers. What is wrong in making sure that it is FIFO....

That's exactly what I wrote a few posts above. I think the more basic question is - What does 485 inventory mean? Is it already filed 485 numbers or "can be filed based on approved I-140" numbers?
To the OP: Can you provide the link from where we can open the PDF instead of just throwing the PDF open. Maybe that will provide a better context to the numbers.

Mntion that while you do have a H1B visa, which makes you a temporary worker not subject to the citizenship status discrimination prevention provisions, you are currently adjusting your status to a permanent resident and are availing yourself of the provision of I-765, thereby being a legal US worker as defined by the DOL and thereby would avail of the protection provded to you under the anti-discrimination provision of the Immigration and Nationality Act, 8 U.S.C. � 1324b.

Here is why it will not happen on the first 3 or 4 days atleast.
This is not like H1B, which was hyped around for 2 months and forced every one to file on Apr 1st. More over it has a cap of 65k on it.
The most imp thing is there must be some rationale or logic (other than for fees etc) behind how they could make every category current. Some of you might know that DOS gives USCIS visa numbers quarterly. It means that the final quarter quota has not opened yet. The final quarter quota for EB1/2/3 is around 22000 (approx 7500X3). The EB5 leftovers ( conservatively 9000 , see 2006 stats) will also be added to the EB1 and possibly down to EB2/3 . The total number of visas that will be available to USCIS on Jul 2nd (first fiscal day of final quarter)is 31-33,000. The per country limits are relaxed in the final quarter so that unused go to the over subscribed countries.
DOS has to be utterly dumb, insane and ludacris to make every category current, if these 33K are the only numbers available. If DOS and USCIS has statistics for the first 3 quarters ( first 2 quarters + 2 months of 3rd quarter) telling that all the visa numbers released were in the previous quarters were consumed 100%, they would not make it current. That kinda tells us that the numbers allocated in the first 3 quarters were severely under utilized. How severely? No one knows as DOS does not do per quarter statistics.
More over, If its written into law that DOS can only issue VB once per month, and cannot update it during the month, they cannot do a damn thing. If it's not, it comes down to the implementation and interpretation of the agency. USCIS and DOS can release an updated bulletin if they get an over whelming filings for EB 485. Again, there is not enough time for USCIS/DOS to prepare like they did for H1, because the rumor has been out for 4 or 5 days. It might happen in the 2nd week or so if its not written into law.

What you guys are talking about ... Walter reed is the best place for the flowers to go, with all what is going on in there ... the media will eat this news . DO not Cancel whatever you Do do not cancel instead call the media and let them know........... This is even better.

I am in a unique situation. I had concurrently filed I-140 and 485(EAD and AP as well) on July 2nd. I received my 485 recripts and EAD Cards but no trace of my concurrently filed 140. 140 check also is not cached. All my applications (140 and 485 were sent in the same packet). Called USCIS and received the routine answer that 140 is not in the system yet and have to wait. Any one else in the same situation

(premium processing will provide those funds)
immigration relief like recapture, more visas etc require congressional approval and i dont think we will see any till mid 2009 after the election is settled.

How could a name check wait for several years? Nobody is working on it, that's how. You can not explain it any other way. There is no streamlined process to process NC requests. All USCIS requests have a priority level 3 - requests WITHOUT specific deadlines. All other problems - bad search criteria that produces too many false hits, the decision to search in reference files for all requests, lack of electronic document depository for NNCP - are secondary. When expedite is requested on the NC, the FBI resolves it in a matter of weeks. In fact, they can process up to 100 expedite requests a week without affecting productivity. That means some requests are just plain ignored.
