Hi,
The plight of legal immigants has been lost in all the noise and focus on illegal immigration. There are about 500K legal high-skilled immigrants from around the world who are presently working in the US legally on a temporary work visa issued by the US Citizenship and Immigration Services and in the queue for a permanent resident card also known as Green Card (GC).
There are only 140K GCs given per year for all employment based categories and the employer who sponsors the immigrant has to prove that the job cannot be filled by an American Citizen through a lbour market test. The 140K number is also used to count the spouse and children of the high skilled immigrant. So in essence there are only about 60K high skilled immigrants given a GC each year. Also there is a per country limit of 7%, so only about 5000 GCs are given to high-skilled geal immigrants from each country. This has lead to a huge backlog in GCs especially from countries which send may high-skilled immigrants like China and India. To make matters worse the Congress authorized about 250K illegal aliens a one time waiver to adjust status in the year 2000 and those numbers come out of the regular 140K per year granted to legal high-skilled immigrants.
All this has resulted in a expected wait of "8-12 years" for getting a GC for a "Play-By The Rules" legal high-skilled immigrant. Add another % years after that to get US Citizenship. Seeing these kind of numbers many talented young engineers , scientists and doctors are moving to other countries in droves. No one would like a wait for 15 years to become a naturalized citizen. America is losing a lot due to this Retrogression (Backlog) in GCs, especially when there is a global competition for Talent. The only ones who have patience to stick on is those who have already been in the waiting game for
years and have a lot at stake to leave it at this stage. And for those that chose to wait in this manner life is hell. For 7-10 years they cannot change jobs, cannot get promoted or even change job roles within the same company, cannot get transferred to a different location in same company. Any of these events will mean starting in line all over again. Also their spouses cannot work and they cannot buy homes or make other investment decisions due to the uncertainity, many who have kids in college have to pay higher tution.
I am one of these stuck in this GC hell for the last 9 years, I came to the United States as a student in 1995 to pursue graduate studies in Engineering in a top-ranked university. I have been employed legally in the US since I graduated in 1997 and been pursuing the GC dream for the last 9 years. The end is not in sight and if Congress does not pass any relief I expect the wait to last at least another 5 years.
What does it take for congress to pass some relief? Just some simple relief measures
1. Increase the numbers of GCs to 250K per year temporarily for 2-3 years to alleviate the current problem.

--That ought to suck every bit of sanity left! I know "should have..would have..." doesn't matter anymore but I am curious why you did not opt to do labor substitution in june-july period. You should have had a crack at it.
I know people on h1 with consulting companies did better than those who got stuck with one permanent job.Stale career , stale pay and so on...

Switched from one FTE to another FTE where I was probably the only H1B FTE working with a bunch of contractors and company would not file labor until first appraisal was done i.e. 3 months. By the time the slow-arse attorney completed the PERM requirements it was already September end. It's just frickin crazy,I know, stupidity on my part too in changing jobs. But opportunity knocks on the door once and was not unfortunately in sync with the idiosyncrasies of CIS and DOS. Hindsight is always 20/20 and no point whining. But having to constantly look at the lucky guys makes me say "Kick the H1Bs out; they took my greencard" :D

Here is my current situation
1. Entered US on H4. H4 is stamped on the passport until 2010.
2. Applied for EAD (July filer) and current using EAD for work
3. Will go to India this year end and planning to come back on the stamped H4.
Here are my questions
1. When I entered on H4, on the POE, the officer would have marked my status as H4. Now, I have used EAD...so currently I am on AOS pending status. How do they know this? Is this based on the I-9 that I have filled for the employer? But I9 form is retained by the employer unless requested by USCIS, so how does USCIS know that I am on EAD (AOS)?
2. When I go to India, I will surrender the I-94 that I received when I entered on H4. So when they tally their records, will they treat me like H4 leaving US or EAD (AOS) leaving US?
3. When I reenter US on H4, again my status will change to H4 right?
4. At this time I assume that the EAD card that I have is still valid (Not invalidated because I entered on H4 and not on EAD/AP. So, If I have to start working again, Do I need to fill the I9 form again for the same employer.
5. If I do not fill the I9 form, then how will USCIS know that I am working on EAD...which means that my status is AOS pending?
6. In my case, the primary applicant chooses to remain on H1. So if our I485 gets denied does this mean that I am out of status because I am using EAD or does it mean that I am fine because I entered on H4 and that is what they have in their record.

Had some colleagues who worked in Detroit and lived in or around Windsor. Took them around 45 minutes to an hour each way to work. One of them had his wife's entire family living in Ontario (they were Vietnamese immigrants). He had a US citizenship so there was no immigration issues. His wife did not want to live in the US and there were no jobs in Windsor so he had to commute. I think one of these colleagues was on a H1 but not sure. The big problem is that there aren't enough jobs in Windsor so chances are that your wife won't get a decent paying job. Then you have to pay high taxes I think as much as 10-15% more. Due to exchange rate fluctuations you can see your living expenses shoot up and down. Just a few more things to keep in mind. Overall yes I think this is plausible and depending on what you want *Canadian citizenship/GC" this could be a choice for you. I would suggest contacting your branch in Detroit and talk to people who live in Canada.

I would support this bill since it makes a lot of sense. I am not going to benefit from this since I have masters and not PhD but people who have sacrificed the lure of big money to live on campus with 2-3 roomies for almost 5 years in which time their friends who graduated are driving lexus and staying in 5 Br homes need some consolation prize. This is a great move for these students as well as the country.
While I definitely support this bill, I fail to understand your logic here. They definitely are bright candidates but they did everything by choice for the personal and professional gain. They should be given GC because they are asset to this country not because they don't own lexus or 5 Br house which by the way tells a lot about other hardworking people who own them.

If Paul's hunch that we'll see the 1Ds' successor by September is correct, then we might see cheaper 1D-II bodies prior to that.
As for the Kodak, it certainly has the resolution, but it doesn't seem as if it's generating much enthusiasm. The 1Ds (with less pixels) OTOH has. Removing the very expensive anti-aliasing filter was probably not Kodak's greatest moment.
I think the Kodak has alot more problems than just AA problems!!!
And any time a product drops by 50% in 1 year its normally not a good sign

The idea here could be to give tough time for people who do not have valid visas. If they cannot get drivers license because they are on expired visa they cannot drive.
Illegals will anyway figure out a way to drive. They may even drive without a drivers license.
We are the ones who have to bear the brunt of all these illogical rules.
Can't we do anything about this ?
I read somewhere in IV that employers can't even ask for the type of work authorization when giving a job.
How come DMVs can ask our immigration status for drivers license ?
There may be scope for some action here.

I applied my first H1B extension through my company in June 2008. On 11th Feb, I received REF. I am very much tense about it. Since I am out of project. I got cleared my I 140 with this company in July 2008.
I applied H1B transfer(Normal process) also in October 2008 to other company . This one is still pending.
I am very much tense about my status. Please suggest me what to do?
Is it better to answer to RFE for first company?

Can I do PP with second company? or else any better thing?

I-102 will not work you need to file I-539 for extension of I-94.
I-102 is for replacement I-94.
I am sorry but the rules clearly state that passport needs to be 6 months beyond the intendent travel period.
Unfortunately for H1 that could mean several months or 2-3 years.
fork up $300 unless you plan to be put of status or can find a cheaper way of flying out to Mexico/canada and flying back in.

The main issue is not the expiry date of the DL, the issue is why make us verify all the documents and add the 6 month validity constraint even for "Change of Address" requests, and why give us a completely different Vertical Style DL unlike the standard Horizontal style DL.
Also, I have not reached that stage, but what happens with people with EAD? You have to renew every year and can renew only 120 days before Expiry. The expiry date of DL and expiry date of EAD will keep chasing each other and at some point you will LOCKED OUT of DL because of the 6 months validity constraint...
People from other states = Do you have to go through the whole verification process even for "change of address" requests?

I am a July 2nd filer - got receipts/AP/EAD and online status for I-485 reads-"case now pending at the service center to which it was transferred." All receipts begin with WAC. I believe the applications originally filed at NSC, were transferred to CSC and then CSC transferred I-485 back to NSC after approving EAD/AP.
Anyone, in similar situation has received FP notices? Please reply or PM me.
