Congrats!!!! Can you please tell the SR process? Do we have to tell the reason why we want SR on the case? If yes, what was your reason to open SR? Thanks!

FYI: I opened SR on Aug 4th... Yesterday I got response that my GC is approved (but the status online was still Initial review) and now today morning my status changed and I got approval email and an SMS too.
Given the above, I seriously think SR works. They must have checked my SR and then approved my GC.

Thanks for the excellent analysis. One question, your analysis assumes category excess visas goto next category on a per country basis, is this correct ?
Example, EB-1 china number goto EB-2 China ? I thought all EB-1 China numbers are added to the excess pool and then given to most retrogressed EB2 category ?

Come to think of it, even the country where we are right now (i.e., the US) isn't much different not only in terms of lengthy forms and queues (outside of consulates) but also on making our lives a little more than hard by denying driver's licenses, delaying permanent residence perpetually etc. On top of these issues, apparent hate crimes against Indians at LSU and then at Duke would certainly make a lot of parents a little nervous before sending their kids for higher education here.

I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don�t have a valid US visa. (Note: If you have AP, and don�t have a valid visa, you still need a TV).
I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don�t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).
Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the �I will kill you right now� look on my wife�s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).
It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.
I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don�t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. Good Question. AC21 usage introduces a "Chicken Or Egg" situation. Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.
Many of us could be over-qualified for our current EB3 position (after so many years of wait) and is accepting the current position only to strictly adhere to "same/similar" job classification. In that case employer can file a GC for our real qualification i.e. Eb2.

ON this org. I am one of them. My PD is Sept 2004 and my labor is approved but I am on EB3 sitting and waiting for I-485 to open up for me. In fact, my guessestimate is that there might be more EB3s here than EB2s but that's something not important right now.
We are going to push for quota raise for all EB GCs, not just EB2 or EB1. Also, the biggest and most critical push is going to be for allowing people to apply for I-485 even during retrogression.

These are stupid quotes that will only make the situation worse. The real solution is to make the fingerprinting independent of the green card process. There is no point in trying to push for a faster name check in the post 9-11 world, it will be shot down legitimately. We need to make sensible suggestions not demands.

The chief voice for American IT vendors in Washington is seeking to switch sides and become a target of Capitol Hill lobbyists.
Harris Miller, 54, this week quit his job for the past 10� years as president of the Information Technology Association of America�the lobbying arm of the IT industry�to run for the U.S. Senate from Virginia. A Democrat, Miller is eying the seat held by Republican George Allen. Miller says he'll make an official announcement on whether he'll run next week. But in a telephone interview, Miller sounded like a candidate. He already reserved a domain name for his campaign: miller2006.org.
Miller says top Virginia political leaders, including the retiring and popular Virginia Gov. Mark Warner, a former high-tech executive who's mulling a run for president, urged him to run for the Senate.
As head of the ITAA, Miller has lobbied Congress to liberalize laws such as the H-1B visa program to allow a greater number of foreign IT workers to be employed in the United States, as well as opposed efforts to penalize American businesses from outsourcing work overseas. Miller's positions on these matters have been attacked by some members of the liberal wing of the Democrat Party who seek to limit the importing of IT workers and the exporting of IT jobs as a way to protect American jobs.
But Miller suggests his views have been misinterpreted by critics, saying he isn't pro- or anti-outsourcing, but recognizes that American businesses operate worldwide and have the right to hire workers in countries where they conduct business. Placing limits on outsourcing could hurt efforts to open foreign markets to American IT wares, he contends.
Instead, government should back programs that encourage the creation of new IT jobs in the United States. For instance, he says he's a long-time advocate of programs to bring broadband and other high technologies to American rural areas as a way to attract IT jobs to those areas. He cites a Warner administration program to create hundreds of high-tech jobs by providing broadband Internet connections to businesses in southwest Virginia. "Five years ago, it was not an option, the area didn't have access to the Internet and technology, and those jobs might have gone to Mexico, India, or China," Miller says.
Miller says the United States isn't investing enough in education and worker retraining, as well as IT research and development and broadband, adding that America has fallen behind some other countries. If elected, he says he'd push for increased investments in these areas. "We have to figure out how to run faster, jump higher than our competitors," he says.
Before joining the ITAA, Miller ran a consulting and lobbying firm in Washington, and served as deputy director of personnel management for Congressional relations in the Carter administration.
Replacing Miller as interim ITAA president is Robert Laurence, who had been Sybase VP of public sector.

I got the RFE at last. I invoked AC21. The RFE for me is asking for 2 evidences
01. Why in Form I-693 medical examiner submitted x-ray but no skin test (we did it because we had the TB vaccination in childhood and skin test would come positive and we had to take x-ray anyway) ---Not an Issue, we can answer that
02. Submit current dated EVL for your new employer. No issue. we can answer that
For my wife also asking for 2 evidences:
01. About the same medical issue.
02. Provide her non-immigrant status between Feb 2003 to Jan 2004.
I don't know what do. Looks like we are doomed. My wife came here with H4 in 2000, was provided I-94 from the airport for 3 years (till Jan 2003), we didn't know then that we have to file a I-539 extension for H4 extension (even couple of my friends had the same idea). We knew that as long as I am on H1, she would maintain H4. I came to know in Jan 2004 and then we applied for I-539. I know this is stupid but that what happened. Anybody has any experience please reply..please please. We are really sleepless this time.

And to make matters worse, this jerk married a Mexican woman. He is alway behind Mexico and Mexicans for some reason. Imagine that, he lives in NJ, has a several acre house, makes 7/8 figure salary and then teaches American middle class a lesson to avoid goods produced in China/Mexico/India. Avoid them because they add up to trade deficit of USA, avoid them because those countries have stolen jobs from middle class Americans. Why doesn't Lou Dobbs stop using software written by some Indian/Chinesse guy? This guy blames mexicans/legal or immigrations for this country's broken health care system. Other day, he was concerned that in California, especially L.A. and surrounding area, white people's percentage has gone below 50%, Mexicans and Indians are having too many kids, whites are not having enough kids.........this is by far the most racist program CNN runs and we need to do something to put a stop on it.
