Some states have the provision that instate tuition rates will only apply to permanent residents while others allow H1-B's to avail of instate tuition. I know for sure that Pennsylvania is in the permanent resident camp while Colorado allows instate to H1-B's. As mentioned previously it is the state legislature along with the commision on higher education which create the rules.
It would be interesting to compile a list of all 50 states to see where each state stands. To do that though it would help if folks residing in different states chime in. Otherwise it would be too difficult to sift through the higher education commission websites for each individual state.

No wonder Congress is not acting on any retrogession reform legislaiton because of only 100,000 backlogged cases. It would probably millions of cases before they took action.

Hi Gurus - Can someone enlighten why lawyers reco. not to inform USCIS about AC21 and wait for RFE?
Also does anyone knows how one can get back on h1b after invoking AC21? If AOS is denied how to get h1b again? (if not exhausted 6 year of h1b)

I never Informed USCIS of my change of employer.
It is not necessary to inform USCIS.
You do not know if the AC21 that you send will be attached to the file.
Some people sent AC21 and they got NOID
Why?
When you change Employers and the old employer withdraws your I-140 then
You get an RFE or you will be called for an Interview because they want to see you
where do you currently exist. Are you following all the rules set forth to get a GC?
Read through that website.
I finally got my GC with any RFE.

This is B*^#S*&^. Take this to an attorney and see if it’s legally valid. I suggest you not to sign as he puts every possible issues and make you responsible for that. I never come across any agreement like this. Normally they ask only for non-competent agreement.
Why do you care if the client does not pay your employer and why you pay for the recovery. Simply Blood suckers. Tell him that you can not sign as he did not inform you about this agreement in advance and its not fair.

Please let us know. I think some Xfr cases are now seeing FP notices, but not sure if they mean anything becuase, bay area, CA FP centers seem to be backlogged more than anywhere else.

Is there a pattern for RFEs? Why some on gets an RFE for AP?
Good question - based on what I am reading on this forum, it seems to me like the RFE is requested for people who travel a lot in and out of the country. My wife has traveled a lot of times - I even lost track in the last 5 years - and she did tell me that they did not take her I-94. It would be still attached to the passport and when she enters back - if the travel time was less than 20 days, the officer discarded her new I-94 and asked her to keep the old I-94 - in some cases, he/she would just take it during entry. This happens mostly when she travels to Mexico or South America. The evidence that was being requested is the dates of travel and type of visa used to enter the country with the required documented evidence on the passport (color copy).

What if the I-140 is approved, I-485 pending less than 180 days and change of jobs to happen?
In this case, can the employer still revoke the I-140 though it has been approved already?
if you change your employer within 180 days of 485 RD, the employer can revoke your 140 which will invalidate your 485.
After 180 days you can switch using your H-1 too. The EAD is not necessary.

Just to add, this is the risk of not working for the company after getting the EAD. The employer can easily prove that the person had no intention of working for the company. AC21 cannot protect that person.
the guy who used AC21 got his GC and rightfully so since he left after 6 months.
Our friend was the one who got the labor sold by his desi employer leech..to him
its good atleast that Ac21 works and it should..now with substitution banned the new AC21s will be protected..as long as they didn't substitute..
Finally labor substitution was a bad choice! thats the moral of the story..
