Jamaica does not require visa for Indian citizens, regardless of US status. One of the very few countries where Indians can go w/o visa along with Thailand and Hong Kong.

Below is data of PD from last four years for EB2-I - only for Jun, Jul & Aug.
Except July Fiasco , I don't see dates ever moving forward in July VB; but they do move in August VB.
Has anything changed in spillover laws in last 1 year - which will explain this no movement in July but in August?

You have to stick to Software Engineer field in order to take advantage of PD recapture. If you move to Business Development using MBA than its hard to justify same or similar. Find a new job which requires EB2 and show BS+5 to qualify.

I have sent letter twice. They forward it as it is to USCIS and send a reply back that it has been forwarded to USCIS for action. Then you receive a letter or call from USCIS that your case cannot be considered unless your PD becomes current.

My case is very straight-forward but some really inefficient guy is making it complicated. I need your experience and inputs. Please do advise.
I came to US on J-1 in 2000. After 3-years on J-1 got 'waiver (i-612)" and then moved on to H1B visa and filed I-485 in july07 (with an approved I-140). I have stayed with the same university medical school (my GC sponsor) since 2000. Last month, I got a simple RFE --asking for a copy of approval notice of 'waiver' . Same was sent within a day and it followed with several LUDs and read rfe response received.....
Last week, got 'Notice of Intent to Deny (NOID)' for myself and same/ditto for my derivative-spouse. It is asking both of us to provide evidence/ IAP-66 and H1B approvals to prove our legal status from 2000 to 2006 (Please, note they asked only until 2006 and not until today). I have IAP-66 and H1B approvals ready to respond to this.
My Question is: Since my spouse/derivative was my dependant and was on J-2 visa, the IAP-66 were all in my name how should we respond to derivative's noid as-far-as IAP-66 approvals are concerned. We know IAPs and waiver are good for dependants and I want to end this back-and-forth with my response to uscis.
Please, advise and let me know of your thoughts....

The whole experience of the rally was really great, meeting the staffs of Congressmen/Congresswomen, IV core team, other volunteers and members, hearing the speeches of Congressmen and being a volunteer.
Rally was well organized and volunteers tirelessly worked all three days. Me and my wife are really proud for being part of this historic event and also proud for the participation of so many fellow CA members.
It would have been great if members from neighboring states have attended in big way.

I just talked to an attorney. He said that if there is a long gap, your H1 may be approved but with out extension of stay (no I-94) and that I may have to go for visa stampling in the consulate in India. As I already have 1.5 years on h1, I was told that it doesn't go thru the cap. some one mentioned in the thread, that once you use EAD, and if u were to get H1 it would be under cap. I am not sure which one is correct.
If you are on H1 and switch to another H1- you do not need to worry about Cap
If you are on H1 and switch to EAD- you have relinquished your H1.Whenever you wish to resume your H1- at that time you will go against the Cap.

My wife changed her job after getting H1B transfer receipt. Her previous H1B is not expired or revoked. After one month with new employer, her H1B is denied. We didn't appeal, but immediately filed new H1B with another employer and give paystub of the denied employer with all details. She got her H1B approved with the latest employer. This happened 4 years back.
So, if H1B denied, you can file appeal or find a new job and file new petition ASAP.
Looks like you got angry.Everybody knows H1 requirements as much as you do.Do you think are the only one who is smart in this world.I don't think so.

I have written to USCIS director and Chairperson of the immigration sub-committee in the House Zoe Logfren about the plight of EB3-I applicants, I have metioned it is mainly because thousands of 245I(Asylum) people were given Green cards from this category. There should be some kind of relief for us. More people write her or other congressmen/Senators it will get more attention. As far as I know 90% of the Lawmakers doesn't know about 245 I cases...

Called USCIS and they are asking me to take an Infopass appointment.
Update1: Infopass appointment was not useful. They asked us to wait for the notification from MSC.
Sorry to hear about that ... try taking another infopass ... they should assist.
Like dhundhun said there must be a procedure for shuttling packets between offices
(When we did a infopass for EAD delay - we got a really good rep - but for a friend of mine the rep was less than helpful - for the exact same thing)

Why every discussion has to end with donate - why donate? What IV has done so far? Where the money goes? EB2 vs EB3... etc. Stop hijacking threads.
By the way, the title of this thread is of no good. Don't give such title to generate clicks, your post is not a media news site to give misleading titles to generate clicks. "Whats happening with EAD delays" would have been more appropriate.
Every discussion gravitates towards donation because at the end of the day, the reality is that there is a need to mobilize funds, to take our game to the next level.
At the same time, there is a whole bunch of immigrants waiting in the queue for 5,7,10 years, passively, just talking, who could have easily contributed $25 per month to create a momentum for us.
All this complaining about transparency (knowing or not knowing that not-for-profit organizations need to follow very strict accounting and disclosure rules), is just not productive. I would rather put my trust in a bunch of fellow immigrants who are trying to help us all collectively.
Even if nothing comes out of it, I would have tried to push my luck through this group, rather than sitting and waiting for things to change on their own.
Disclaimer: I am not a part of the core or any peripheral group of IV. I am just like everyone else, but have decided to try my bit by contributing.
