Does one need to be physically present in US in order to file I-485 application? I had already booked my travel to India on May 25th before I came to know that the my Priority Dates had become current. Will I need to be in US till I get the filing receipt? I was curious on how would UCSIS know that I'm out of country on the day of filing?

    Thanks

How will USCIS will know? They have all your immigration related documents including I-94. They can track all of your movements.

I did it on behalf of GC4Me.

Hi gc4me, Can you please open a new thread that you have got a phone call from Ombudsman. People will see the thread and will get more motivated. If you think, it will not help, please ignore.

Yes. No one has bothered to go after DOS for misinterpretting the AC21 rule in allocating immigrant visa. Many people (EB2-India) raised their concern between 2003 and 2006, as DOS is not correctly following the rule and allowed the spillover to go EB3, when EB2 was in high demand particulrly from India. Even IV core did not go after DOS. As you mentioned, lawyers has no incentives. EB3 has enjoed between 2000 to 2006 (from the mercy of DOS). For example in 2006, EB2 got about 25,000 visas abot 20,000 visas (from EB2)has gone to EB3-ROW.

IV from my interpretation is about ending retrogression and increasing total visa numbers and not about reallocation of visas and spending resources on a zero sum game. This issue should have been taken up by affected individuals. I'm sure they did it though because DOS has awakened to the fact that they were not following the law.

My MTR is still pending with USCIS since 6 weeks. I sent form 7001 to Ombudsman office and got a one line reply that 'your case problem request is currently being processed'

Sent letters and supporting documents to 2 US senators, but i got standard reply from them saying they need 30days to find the status. Office of one senator (NJ) was very helpful but not sure how this helps in resolving my case..

    hello all,

i will really really appreciate your posts..

its been 23rd day..H1B renewal..New Delhi..still waiting for PP..i got no slip ..no warning to wait ..nothing..

But now i think its not stuck due to PIMS..it could be anything ?? some admin processing ? some security check ? some name check ??

How do we differentiate what are our passports held up for..COULD THIS BE CALLED 221(g)..i read in forums..221g can take forever ??

    -Shahuja

I am not very sure but my understanding is that consulate will tell you if there is any issue reg security clearance etc (in other words 221 g).

Did VO tell you anything about administrative processing during your interview??

I also had my visa interview on 27-DEC-2007 @Mumbai (h1-b/h-4 renewal) and was told that I will receive an email in 2 business days, subsequent to which I will have to go to VSF office for getting my visa stamped.

Its been 6 business days and am yet to receive an email..I contacted VSF in Mumbai and they told me that all the H1-B applicants are in the same boat and they could not predict any time line...Planning to call the US-consulate tomorrow to see if they can provide some timeline..I already have rescheduled my return flight to US...If things continue this bad, am planning to use my AP to travel back to the US.

    Regards,
    DK.

Not sure I understand this line

Called the DOS. Told them I need to travel to my home country and asked them if they can verify if my information is in PIMS. She asked if the H1-B is an extension case which it is. She said the extension cases are taking a bit longer than the new ones. That is quite surprising. Finally she looked in the database or whatever and said they do not have my extension information yet. All they have is the information from the expired petition. No timelines just asked me to call back in a week.

I need to know if anyone had any luck if their lawyers pursued this matter with the DOS.

What is the phone number to call to verify the information?

There are laws and there are exceptions. Basically there are no Laws when it comes to Immigration. USCIS/DOS can do whatever they like.

Look at Jul'2007, people with EB3 PD of 2004 got approved and people with 2001 are still waiting.

Look at EB2 approvals these days. People with 2006 PD are getting approved and people with 2004 PD are still waiting.

Can somebody explain how PD in each VB goes backward? Is it possible to get new applications with older PD in between? Don't they have computers with all the data where they can see how many applications are pending?

Howcome they were giving unused numbers to EB3 till last year and how come they changed the interpretation this year. The rule didn't change, they simply changed their interpretation of it.

If EB3 would have known about this new interpretation then they would have never applied in EB3 category.

Bottomline is there are no rules. USCIS/DOS is doing whatever they like and playing with our life. Nobody knows how many applications are pending. Nobody can predict the VB movement, it goes forward and backward. We cann't plan our lives and live in limbo all the time.

I dont expect USCIS to get all emotional because of our flowers and issue an update to their updated bulletin saying they will now accept and issue green cards.
The point is that we need to make awareness that there is a HUGE community that gets affected by every move they make and that we are an active and cohesive community and also to create awareness of this debacle.

Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right. Why cant you guys understand this simple fact?. Now stop making fools of yourself and get a life.

That USCIS director gave a good answer. Is your pain more than those citizens of this country who gave their limbs and life for US?.

BTW, i am one of the guys who couldn't file I-485 because of this fiasco. But i understand the reality.:)

09/15/2008: Frustrated IT Industry Lobby - After a Frustrating Year in Congress, Tech Groups Plan Merger to Reinforce the Industry's Lobbying Power

Report indicates that the IT industry has failed in lobbying in support of employment-based immigration and other issues, experiencing repeated failures in the legislation as demonstrated in H-1B reform proposal and EB-visa number recapture, etc. For these reasons, the lobby groups in the IT industry are reportedly working on regrouping themselves including the merger among the groups for apparent purpose of reinforcing its lobbying power for the legislation and other political/policy decision

I called the department of state, visa's section to enquire about this PIMS verification. They said that KCC handles it. When I called KCC they said they cannot check ahead of time

Folks who had delays in getting H1b stamped due to the PIMS system:

Can you look at your I-797 and see if there was an A number (something like A123 456 789) mentioned under the "Beneficiary" box?

    Thanks gcnirvana.

I have a copy of my approved I-140, and the only number I see on it is Receipt Number at the top left side of the notice. It reads like LIN-xx-xxx-xxxxx.

Is this the A# number you are referring to?

That is your receipt number. In my case, the A# is in the box that has the name of the beneficiary.

Total BS. Do you know how the market is. We have 2 open positions (dot net developers) that I am trying to fill up. We have got over 200 resumes in less than a week.

So many consulting companies are offering H1-B resources at 40 to 50 dollars per hour.

Wake up and smell the coffee.

Hello.. Read my msg. again. I hiring managers are prefering onsite over offshore. Your reply doesn't prove anything otherwise..
