    My Guess is , It is a rumour . since the USCIS suspended the I -140 Premium Service for the month of july . It clearly indicates they are aware/expecting many of the I -485 filings from July 1st and do not want to promise I- 140 decision in 15 days during July .

    As per my understanding it seems that these 12000 visas are coming from the first 6 months of the EB1 under usage only and there is a good change that we might get another 8000 to 10000 EB1 visas fall down to EB2 in next 2 quarters. Please correct me if my assumption is not correct.

    I need your opinion and advise on this.

    EB3-Country: India(Bharat)-RIR-PD:07/2*/2003, I-140 approved - 485/AP/EAD/G-325 A filed on 07/12/2007 - EAD received, Soon FP appointment - NO AP yet - (myself-Primary+3) filing

    New file - Second File:
    ---------------------

    Future Employer: B
    EB2-Country: India(Bharat)-PERM: PD:06/2*/2006,I-140 approved - NO 485 is filed under this yet.
    Note: Labor for both applications has similar codes except new filing is based
    on "Seniority" and thus EB2.

    Now in light of October 2007 visa bulletin prediction given on www.murthy.com, It looks like EB2 may go ahead with comparision to EB3 ( Eb2: may stuck at January 2003 and EB3 May 2001/2) and by reading page 130 to 134 from the following link it looks like Priority date still matters even after filing 485 and your case can go on VISA HOLD SHELF if at the time of adjudication visa number is not available.

    Questions:

    1) Suppose my EB2 PD (I-140 approved, no 485 filed) become current prior to
    my EB3 PD (current employment- 485 is filed under this) and for some
    months if I see EB3 may not move ahead what would be the best startegy

    - PORT (EB2 PD: 06/2*/2006) PD to my current 485 file which is based on
    EB3 with PD 07/2*/2003. Can we PORT NEW PD to the file based on OLD
    PD? I know OLD PD can be ported to NEW PD but what about reverse
    condition?

    - File another set (Myself+3) of 485 as new application under EB2 (Future
    Employer) mentioning current A# numbers.

    - File another set (Myself+3) of 485 as new application under EB2 (Future
    Employer) mentioning current A# numbers with PORTING of OLD PD (EB3
    PD 07/2*/2003).

    Yes, this is just one account and am happy for you that you got lucky. I too went to New Delhi Embassy and have been stuck since Jan 7th.

    I have been in the US for almost 10 years and with the same employer for the last 7+ years. This was 11+ year H1B extension and I am stuck since Jan. 7th. I was told Additional Administrative Processing - and have not heard zilch back from the embassy yet. Law-firm has written to the embassy and reaching out to the DoS. I have been calling DoS every week religiously only to hear that "AAP is in progress and you will have to wait it out". Separated from family, living out here on my own - thankfully I work for a global company but working all-nighters will eventually get to me.

    Having said that, it is a matter of chance for everyone. Just be careful and plan accordingly. If you can avoid it, travel using an AP.

    I had my H1/4 (wife) stamping 2 days ago at Mumbai. No issues what so ever at Stamping. My discussion with the officer was cordial and friendly.
    Went in at 9:00 and out by 10:00. Received stamped PP next day.

    All docs OK. No job change after H1 transfer 3 years ago

    All those going for H1 stamp do NOT worry. Not sure how one gets PIMS but this is just my account

    Spatial, I agree with your views. There is nothing in INA which clearly talks about how the spill over should be allocated. USCIS is acting on its own whims and fancies. In last months' visa bulletin they mentioned questions were asked on how the spill over was allocated and decided to make it horizonal instead of the historical vertical spill over. So I am sure we should get some concrete answer how they decided to change it. Based on what ? which clause of INA states that ? I think we should all write letters to Mr. Oppenhiem demanding explanation on the same.

    Yes, I agree that not filing GC earlier is not an excuse for MBA. The point is he still would have been in the same situation (EB3, 2003 is not too different from EB2, 2005) in terms of how fast he will get his GC..

    It is really better. He can recapture his old eb3 PD after getting approval for eb2 based I-140 for the manager job.

    Law provides equal opportunity to everyone for PD recapture. This is my point.

    And, for those who are going to argue that no one is going to file GC for him in 2003, this is not a valid legal arguement. Granted, it may be a emotional one.

    On a related note, how many people REALLY agree that GC is for the future job? But they never dispute that in court of law because it does not hurt their case. Anything that hurts their GC cause makes them victim and root cause for gaming the system.

    dude you are yet to show data to correlate students graduating correlating with H1 visa numbers. You say that Ms/Yahoo/Goog have no peers in India yet refuse to acknowledge these guys stand on visa status.     Hi All,
    I got the I-485 approval/welcome notice from USCIS for myself and my spouse today. But the wierd thing is that my NSC online status still shows RFE response received and case pending (from 2008)...the welcome notice says I should expect to receive the card in 3 weeks...guess I am greened.
    Anyone else face a similar situation?

    Except for the Priority date (Feb 16th 2006) everything else is different. I got a response to my Status Request by snail mail today that my case is pending adjudication by an officer and please call us back if you don;t hear from us in 6 months!

    I support you L1Fraud.

    Guys: This has become a major problem at every place. If we do not take any action, every one of us will be replaced by these BIG outsource companies with L1 and B1.

    I already reported this to ICE about violations of CTS which has placed their L1's at client's place for the past 2 years. And still they have several people.

    You may not believe their pay. I do not want to put a number here and it will be a shame on CTS for misusing L1. They replaced 18 American Workers at my client's pace. Whatever you guys might think, this is a FRAUD.


    This is exactly what I have been arguing for in another thread about the Grim visa numbers. I will fully support you in your cause and let me know if you need any help. I am a GC holder but I feel its my duty to report this fraud against all these outsourcing companies.
