Hi all,
I am from Grand Rapids. I'd like to help.
I think, It would be a good idea to get an approximate count of legal immigrants who are stuck in the GC process in Michigan. We should use these numbers to write to our Senator and make them feel that the State of Michigan is not about americans only, its about us as well.

We would like to know the count of GC waiting applicants with US citizen children.
Is there any plan to propose another class to USCIS in addition to EB1, EB2, EB3, ...?
I may have to wait for 25-30 years for my grand-childrens to sponsor me.

Krishna_brc is correct. H1 B alien can be on medical leave, sick leave and can be unpaid during that period.
Get a letter from your employer saying they are granting you a personal unpaid vacation as per your request(which can be done using a pre-dated letter to them). Make sure you are getting your medical coverage from them(if you have it through them). Provide that and an explanation that you are taking personal time off due to health etc/stress. Hopefully that is flies with the USCIS.
Per law you are can get vacation for which the company has to pay you or you can also avail of unpaid vacation.

Yesterday evening even my case got transferred to local USCIS office . I have LUD on my I140 for today.My daughter's case is still with old LUD.

To the bro who suggested I rather stay here than go back..well I work as a consultant thro a vendor hence that is not an option (thanks to the new memo).
Given the market is so hot in India right now and here new policies are made to make our life tougher, only makes one's consideration to move back stronger.
I will call up SSN office today and check out how much more is remaining of the 40 Q for me...will try and do that.
On RONR, I will find out and post here when I have any confirmed updates - but one thing I know for sure is:
Tax year starts on april 1st in India. If one stays atleast six months starting that date, he is still considered NRI. Hence say if you deposit 40,000 USD in SBI on may 20th...and return after october 10th, you are okay. No tax in that year..but if you came back before the six month, then there is some tax that you have to pay.
NON - RESIDENT STATUS UNDER THE INCOME TAX / WEALTH TAX ACT:
Condition Status
1. He is not in India for 182 days or more during the relevant previous year. >> If yes, then he is a non-resident.
(so check the next condition.)
2. He is not in India for 60 days or more during the previous year and he is not in India for 365 days or more during the 4 years prior to the previous year. >> If yes, then he is a non-resident.

Sorry to hear that. My friend also got very much similar RFE for H1 extension. Company replied to the RFE with the help of one of the best attorney's. It has been almost 3 months since he replied. But no action so far from USCIS. He is using AP to travel to india. There is always a chance that USCIS may issue a RFE on your 140 as well. My friend is planning to change the employer to avoid this mess. Consult a good attorney to come out of this.

According to an IO i talked to recently the background check has 6 stages which includes name check.
Sometimes for verifying the names and address they send it to local USCIS office for verification.
So it may not be for interview. But you could be in the last stages of the background check and will be approved soon IF the dates are current for your PD.

Just a quick update
Today my checks got cashed and from the back of the checks I got the receipt numbers. I was able to track these numbers on USCIS site and the EAD application for myself and my wife is now pending at TSC.
So the mailing address to Mesquite, TX turned out to be the correct location for me to file...
So it took less than a week for them to receive the package and cash your checks! I sent out mine to NSC today. Lets see how long it takes.

I had applied for I-140 Dec last year(2006) EB3 and was checking for update and found that an RFE has been sent on Dec 12. To whom is RFE sent....My company had done all the paperwork...is it to our company lawyer or me....Please advise

Update:
I got the results back from the civil surgeon.
He basically attached the original i693 form, updated the TB section which he had forgotten earlier. He also had taken an xray, so attached an xray report. Both of these, he sealed them in an envelope and I shipped that to USCIS with a covering letter and original RFE letter.
USCIS accepted it the next day and since that day I am seeing a lot of LUDs for my wife's case. I am sure that this is normal. I will just have to wait until they find something new! For now I think everything looks good.

I agree this is not easy, but in past IV CORE was successful when they convinced CIS to come out with revised visa bulletin in July 2007. Other successes include 2 year EAD and 29 months OPT etc. If we all support, this may also be possible. Atleast having an official procedure and forms for AC21 will be really good.

Except July Fiasco , I don't see dates ever moving forward in July VB; but they do move in August VB.
Has anything changed in spillover laws in last 1 year - which will explain this no movement in July but in August?
