AT the POE the visa officer will know where you are. Apart from regualr list of docs for h4 stamping I dont think any other doc is required! But please verify with your attorney.

mallu is right. H1B status expires immediately when a person stops working. An employer is required by law to notify the USCIS about a lay off and the USCIS revokes H1B as of that date. There is no grace period, so the only chance to preserve H1 status is to find a new job and file H1B transfer BEFORE the lay off. Preserving I-485 is a different story and you are in a good shape regarding GC. Just find a new job, use EAD and stop worrying about H1 status. It does not worth the hassle and you may not get any benefits from H1.

At the same time, keeping everything transparent is IV's duty. IV should not wait for someone to ask these details...
Yes true, and whatever $100 I'm donating is going to benefit Ivar more than me since he's current.
It looks like no one is watching the IV video posted above. The summary is:
1. IV is a non-profit, and these orgs have very strict tax laws.
2. If funds are misused, people can be put in jail and deported.
3. Complete disclosure of strategy, investments will hinder IVs ability to campaign as anti-immigrants and our opponents are looking at our strategy to quash it. This is especially true with lobbying.
4. Previous years annual reports are available.
Facebook or Google are not going to publish their daily funds usage report or they will be out of business in 1 month
The reason I'm asking for donations is - Without thousands of members donating, we cannot successfully lobby for Green card laws for us.
Its not directly going to benefit me, I'm still a long way off.

Guys, If we try something its not gonna hurt us. If we don't try we may have lost an opportunity. The least that this dude can do for us is listen and then we can follow up.
I insist, again, lets talk abt soc. sec treaty. With thousands of us having together millions in that account, the US gov. will have to do something. Remember-its our money- the US govt. cannot deny it if asked by The Indian govt. IF they wanna keep it, better give us our GCs!

Can you please share your experiences with renewal of Indian passport in US. They are asking for 3.5cm x 3.5cm photos which are not same as the regular passport size photos. The CGI Houston website mentions passport size photos as requirement in some places and 3.5cm X 3.5 cm photos in some other places. Can you please share on what you did for the photos? thanks a lot.

I would suggest you to renew it here in US. If you don't have time to mail in and receive , then you can visit the consulate and get in back the same day. I am sure it would lot of time in India :-)

I need urgent advice from you. As you know my wife is on F1 visa and completed most of her credit hours needed by school. She has get only 1 credit hr to complete the course. However, that�s below 9 hr full time student status. She has been asked to register for additional 8 hrs..and pay tuition fee accordingly ( > 8K). Which I think is unreasonable. They told her that if she doesn�t register by tomorrow they have to report it to INS. She told them that she has EAD..there answer doesn�t matter in order to remain in school and F1 visa she has to register.
My questions is:
1) Can she continue working on her Thesis on her EAD and AP ?
2) What will happen to her f1 if she use EAD
In response to these questions my Lawyer said
1.) yes, she can continue to be a student as an adjustment applicant � she can work using the EAD and travel using the AP.
2) she is basically no longer an F-1 because she has demonstrated immigrant intent by filing the adjustment. Which is fine � she has valid legal status as an adjustment applicant and can work with the EAD and travel with the AP.
What do pro�s think..:)

I am in the same situation. They say once you start using AP, H4 becomes invalid....my wife IS working on EAD, she was in India for a while and came back on H4, again resumed job on EAD...then we renewed her EAD and put her current status as H4.........no issues whatsoever.
Use EAD, travel on H4......live life. I do not see any issue.

Plus the primary applicant is on H1 and hence we both can enter on H1 and H4 respectively rather than one entering on H1 and the other on AP. Guys, I wanted to circle back and update you on the results. My I140 was approved today and this is what i had submitted as alternate evidence. Hope someone else will benefit from the details I am putting here.

> Experience letter non-availability as an affidavit mentioning that we tried but previous employer did not provide the letter.
> Email trail of communication with ex-employer detailing communication asking for exp. letter.
> 2 affidavits from previous co-workers detailing job responsibilities, skills, dates employed together.
> For 63 months of last employer experience, paystubs, W2's, Indian Form 16's, Indian IT returns, yearly appraisal letters, other evidence related to employment(not all but whatever was available).
RFE was :
Asked for evidence to prove 60 months of experience as listed in PERM.

what is surprising is that most of the IVans predicted that the SEP VB will make the dates U for most categories and also the dates will retro. Also Ron Gotcher too predicted that the dates will retro.

If you are H1 - as long as you are an employee - the employer has to pay the salary as per H1 papers, whatever be the business issues. If that be the case they can be reported as a violator.
Non solicitation clause should state a time frame - but otherwise most contracts have them
