    Sorry for not mentioning in my first post earlier... Just now I received a copy of the Letter which my company received from the USCIS. It is mentioned as "NOTICE OF INTENT TO DENY (NOID)".

    Reasons:

    - Section 203(b)(2)(A) of the Act states
    - 8 C.F.R 204.5(I)(3)(ii)(C)

    These are related to the Education for 3 yrs degree..

    - What is the next step ?
    - What is the chance of a positive result?

    I will not be good in english (en fact with the new bill i am in trouble....) but as european i can tell what is the real situation in europe is different of what Communique says.     I visited my local USCIS office and the officer told me that they don't do I-94 updates and asked me to contact the CBP office. When I called them up to get an appointment, I got transferred to a lady who asked me the details. After listening to my case she said its perfectly okay and asked me to attach the new I-94 from the 797 to the passport. Is this true?

    I am trying to get hold my lawyer but in vain. Please help!!!

    If you refer to some thread, please do not ask others to search for it. Instead paste its link in your post so others can read it.

    I heard from my friends there are no legal implications if you get laid off on EAD and you also have a valid parolee document.

    This should get verified from an attorney though, specially if others create a doubt.

    I am in a similar situation. My current H1B and my wife's H4 expire on June 20th, 2007. I have filed for my 7th year extension as well as my wife's H4 extension in Dec 2006. I got receipt notices for both the application with a notice date of Dec 21st, 2006.

    I am planning to apply for my wife's H4-H1 in April this year under premium processing and I was wondering what would happen to her H4 application if her H1 petition gets approved first. Will she be out-of-status between June 21 and Sept 30, as her H1 would start on Oct 1st. Also, what happens to her H1 if her H4 is approved after H1.

    Any thoughts.

    Hi Guys,

    My LCA has Computer Software Engineer as job title.I have 5 years of Experience as Oracle functional consultant.Currently I'm working as Oracle consultant.My 140 is approved and got my EAD card.In jan 2008 it will be 180 days of filing 485.I want to change my career towards IT Sales.

    I have an offer from an American Staffing company as a Technical Recruiter.The job responsibilities include hiring Software Engineers.But the job title is different from my LCA.I want to join this company using EAD in jan 2008 and apply AC 21.Today I have checked with my Lawyer this is what she says"

    In instances such as this, when we send the letter to the USCIS regarding AC21, we include the following details with reference to the job title. … Although the job title differs, the job duties are substantially the same. The title used by the company is their internal designation for this position."

    She says that i will be able to work as Technical Recruiter using EAD.Any one can suggest me on this?I have very little knowledge about AC 21 and how it works

    Hmm, I am an oracle apps programmer too, although my job is more technical and less functional. Recruiting talent is a whole different job role than working as a functional Oracle apps consultant. Functional jobs (Oracle or SAP) is pretty much business analyst job, in my opinion.

    Now, you may use the same knowledge as you do, but still, its a different role and I think its highly risky to do this change. For example, let's say, you use same knowledge to work as a professor of computer science in University or as a practicing software solutions provider. IN both cases, you use same talent to do your job and use same knowledge and skills. But TEACHING is different job and providing software solutions is a different job.

    Same way, staffing/recruiting is different from doing functional analysis and I would be surprised if the job descriptions match close enough to fit in same job code. Try to get a good lawyer to match the job descriptions and interpret them into job code and see if the job codes are the same.

    My priority date is June 2006.

    I was with consulting company till 06/2009 after which I joined the client (fortune 10) company as full time employee. I'm on EB3 category using my EAD.

    When I was with consulting company before I left they filed for my EB2 labor which is now approved.

    Here is my DILEMMA.

    OPTION#1) I can join my previous employer. i.e. the consulting company for interfiling between EB3 and EB2 so in which case if I go for premium I140 processing I will be on EB2 within a month or so.

    BUT I'll have to leave my current full time employment which is with a fortune 10 company and good pay, I'm not comfortable to leave this position AND I do NOT want to loose the opportunity of getting my GC as soon as possible as EB2 dates are so close to my priority date.

    OPTION#2) Discard the approved EB2 labor that my previous employer (consulting company) have for me and ask my current employer (fortune 10)company start my EB2 PERM labor and premium I140 and then interfile. IN THIS CASE, it might take about an year for me to get on to EB2 category BUT by then I'll miss the EB2 train if the dates become current before I get on to EB2 category....

    Please provide your advice/inputs on what options I have, Do you know any other options than above specified.

    Has anyone gone through this situation and how did you handle?

    Any other feasible ideas that help me keep my full time position with fortune 10 company and as well get my GC on EB2 category.

    I think the contributions are only from those who visit this forum regularly on a day to day basis. I think there are just many people who might have just registered to get some updates but don't necessarily visit this or any other forum regularly.

    A lot of people I know get their updates from the web site of one of the law firms, but don't necessarily participate in this or any other forum. Otherwise, they just carry on with their lives hoping some law will pass some day.

    Some of those to whom I have talked about contributing to IV have politely said they will take a look at it. Otherwise, I feel they have just been institutionalized in their current setup and lives. I don't think the message has really reached them that there is a need to participate and contribute in a organization like IV and try and make a difference.
