I am surprised that Capitolone did not accept EAD. I do not see any issues for them with employing somebody on EAD. Personally I think a lot of banks and other financial institutions have been neck deep in losses from the Mortgage melt down and they are laying off staff and put a halt on the hiring. I suspect this might be the case with Capitolone too and may be they do not want to admit it. Once you have an EAD do not stick with one company, apply for multiple opportunities and go with the best offer. I would advise every body with EAD to try and secure a job if they are not working currently, because with the weakening economy this will be a period where the job market will suffer.

I saw that Ron told one "so depressed" in his Forum..that we can launch a law suit..against this new interpretation..however..I dont know its worth the time and effort..although uscis learns only by law suits..
Lets see next months Visa allocation for the new year and see where it starts from..I am hoping from Mid of 03..lets see..besides..only quick solution so far is the Visa capture ..dont know where it stands...
we got 20 more days to influence people about EB-3 numbers..what is the most effective thing to do collectively before he new Visa bull comes out..

Good news for your guys. I am EB3 but recently my labor got approved in EB2 and very soon I am going to port PD from old labor. :DHa..:Dha..:Dha..You can�t stop me and very soon I am going to stand in front of you in EB line.
How come you couldn't file in eb2 in the first place? Not a personal statement, but I'm still trying to understand this matter.

husband files for himself - I 485
Wife files for herself - I 485
If one of the apps are approved, the other can Join.
No risks....
yes, this sames to be the safest option. only catch seems to be:
- if you are on EAD, then you how do you join? your EAD is based off your I485, which u are presumably abandoning so you can join the other application.

Even USCIS has pre adjudicated all AOS cases , DOS will not be in good shape to predict perfect cutoff date ever. WHY ?? Every year in Sep DOS move dates forward in order to prevent visa waste. Lets say because of these pre adjudicated DOS knows that they are 10k pending app before Sep 2004 and supply is 7k. Still they will move date till 2004 Oct just to give room to USCIS. If they move date to July 2004 which has 7k app and supply is also 7k and some how USCIS has problem approving some cases because of some reason then they will waste few visas.
Till last year DOS was moving date randomly but this year they had move date with little offset. In Oct they moved date forward little bit because DOS think USCIS will not be ready with those left over case from 2004. If they will then they will chew Oct supply and 2005 Jan applicants will not get any visas. Again supply in Oct is only few hundreds visas to only lucky people from 2004 and 2005 will get green card. Agreed. But EAD doesn�t apply to EB based immigrants alone. There are hundreds of thousands of family based immigrants who use EAD until their status gets adjusted and I-140/AC21/180 days etc. are not applicable to them. Same applies to the spouses of EB applicants. In such cases it�s a waste of time/money for the company to consult with the legal department.
I believe it�s the responsibility of the EAD holder to communicate what he expects from the new employer (like AC21) after which the company could decide whether to go with the legal department or not. Just assuming that all EAD cases fall under I-140/AC21/180 days etc. is plain ignorance.

Let me make one thing clear. Govt has defined EB categories : EB1 , Eb2 and EB3 . based on level of exp and education etc..
Now that your employer has applied for you in Eb3 even though you were qualified under Eb1 or Eb2 then govt can't do any thing. Like if you are making 70k with 5 years exp and which is ok as per your labor cert of H1b then govt cannot do any thing . Even though u r less paid compare to market.

Why dont we work hard and hard to get HR 5882 pass. One of my friend has MS from USA from top uni. with 18 years of exp from India and 3 years of exp in big 5 from USA. Still his recent employer applied under Eb3 . Should he complained to govt ???

My husband and me work for the same company now. He applied in EB3 (India) and PD date with December 2006. I-140 approved and I-485 applied in July 2007. Got EAD and AP for both but still working on H1B (Not used EAD and AP).
From other company, in 2007, I applied for labor substitution and it is approved yesterday, which has PD Nov 2004 (EB3 - India). One of my friend working for this company and I got the reference last moment and I was not hoping for this approval.
Now I have to switch to this company as the company management are asking me to join the company. I read many threads in this forum and this thread too about multiple filings of I485s and withdraw one while applying other.
I read some people had no problems with multiple I-485s. But Murthy's advice is against this while others like Rajiv in favour of this.
Please advice me what could be the best in my case.
I have PG in engineering (CS) from India.

Just straight 485. My wife's 485 has EADs, APs, for both of us. Now both of our lawyers said it would be fine. It is not about what USCIS wants, however--it is about what they will lose court cases over. They can't possibly dissallow multiple applications after the fact, after we've paid for them. If USCIS was going to x-nay this, their window of opportunity is over. By not barring it, they've defacto allowed it.
